Cabell County man says he did not intend to kill his wife

HUNTINGTON, W.Va. — Testimony will resume Tuesday in Cabell County Circuit Court for the murder trial of Harry Smith, 69, of Barboursville.

Smith is accused of shooting to death his wife, Constance “Kay” Smith, 62, at the couple’s home near East Pea Ridge in July 2011.

Cabell County prosecutors have claimed Smith intended to kill his wife, but he took the stand in Cabell County Circuit Court on Friday to deny those allegations.  He testified he thought the murder weapon, a gun, was unloaded, but it went off when he was handling it.

“I didn’t know she (Kay) was hit, at first, and then, when I realized she was, I panicked,” Smith told a jury on Friday.

The Cabell County Courthouse will be closed Monday for the Veterans Day holiday.

A final defense witness is expected to called to testify on Tuesday.
