Cabell man gets maximum sentence for wife’s murder

HUNTINGTON, W.Va. — A Cabell County man will likely spend the rest of his life in prison for the July 2011 murder of his wife.

Harry Smith, 69, of Huntington was sentenced to 40 years in prison, the maximum, in Cabell County Circuit Court on Wednesday.

Smith shot his wife, Constance “Kay” Smith, 62, at the couple’s home near East Pea Ridge.  Investigators said Kay, a retired teacher, was shot at point blank range.

Last fall, a jury in Cabell County convicted Smith of second degree murder.

Smith has continued to claim the shooting was an accident.
