Stiff sentence in Kanawha County kidnapping, rape case

CHARLESTON, W.Va. — A Kanawha County circuit judge described herself as being “horrified” by a kidnapping-rape case before handing down a stiff sentence Friday against the Charleston man who committed the crimes.

Judge Carrie Webster ordered Michael Dale Salisbury, 30, to spend up to 68 years in prison after he entered a Kennedy Plea to burglary, robbery and sexual assault charges.

Salisbury entered a Dunbar woman’s mobile home March 6 while the woman was sleeping. She woke up and Salisbury was on top of her. He was wearing a ski mask. Prosecutors said Salisbury sexually assaulted the victim, chased her down after she tried to escape, forcibly took her to an ATM where he made her get money from her account.

“You’re a rapist, you’re a kidnapper, you’re a bully, you’re a terrorist,” Webster told Salisbury Friday. “Monsters live among us and sometimes we don’t know them.”

The judge read the a statement from the victim. She said she still has nightmares about that night and many times finds herself crying. Prosecutors said she agreed with the binding plea deal offered Salisbury.

Judge Webster said the 20-68 year prison term she handed down for the crimes of second degree sexual assault, nighttime burglary and 2nd degree robbery won’t begin until Salisbury finishes a 3-10 year prison term from a previous case of fleeing police while under the influence. The judge said if he’s ever released on parole he’ll have to serve 50 years of supervised release.

Under the Kennedy plea option, a defendant doesn’t admit guilt while at the same time being convicted of the crimes.
