Magistrate denies dismissal motion in Plants case

CHARLESTON, W.Va. — A magistrate rejected a motion Wednesday to dismiss a pair of misdemeanor domestic-related charges against Kanawha County Prosecutor Mark Plants.

Plants’ attorney told Magistrate Mike Flanigan of Mercer County Plants had been denied access to a speedy trial. Flanigan disagreed but he’s yet to set a trial date.

The cases on alleged domestic battery and violation of a protective order won’t likely go to trial until next spring after Plants completes a batterers intervention program in Putnam County. Cagle told the magistrate Wednesday Plants is attending classes every Tuesday night.

Plants is also waiting to hear from a three-judge panel on the request from the Kanawha County Commission to have him removed from office. Plants fought the attempt during a hearing last week.
