Complaint filed against magistrate

CHARLESTON, W.Va. — An extraordinary complaint has been filed against Harrison County Magistrate Mark Gorby by state Supreme Court Administrator Steve Canterbury after Gorby was charged this week with sexual abuse.

Canterbury filed the complaint Friday morning with the state Judicial Investigation Commission. The commission will investigate the allegations and make recommendations to the state Supreme Court, which will then decide whether to take action against Gorby.

The criminal complaint filed against Gorby, 60, by State Police alleges he sexually abused his stepdaughter at the time in 2005 and 2009 when she was eight and 12 years old. He’s charged with five counts of sexual abuse.

Gorby is free on bail awaiting an Oct. 22 preliminary hearing.

In past extraordinary complaint cases the Supreme Court has taken no action against the judicial officer to suspending the person without pay.
