Fake marshal pulled over undercover cop

CHARLESTON, W.Va. — A Charleston man faces prison time for impersonating a federal law enforcement officer.

John Swain II, 52, admitted in federal court Wednesday that he was acting like he was a U.S. Marshal when he pulled over a driver on Interstate 77 in Charleston back in April. He had a passenger in his vehicle wave a fake identification badge. It turned out the motorist Swain pulled over was an undercover Charleston police detective. Swain told him he was driving too fast.

Swain also told the detective he was with the U.S. Marshal Service in Richmond, Va. It wasn’t true.

Swain faces up to three years in federal prison and a $250,000 fine at his Feb. 23, 2015 sentencing.
