Hazelton inmate convicted and sentenced for assault of fellow inmate

CLARKSBURG, W. Va. — An inmate at the U.S. Penitentiary at Hazelton has been convicted and sentenced for the assault of a fellow inmate.

Victor Herrera, 49, will serve an additional 12 months.

In July 2013, an altercation among multiple inmates in the recreation area at USP Hazelton escalated into a physical confrontation. During the exchange, Herrera struck, kicked, and stomped on a fellow inmate.

Herrera admitted his role in the fight when he pleaded guilty Monday to one count of assault resulting in serious bodily injury.

The Federal Bureau of Prisons and the Special Investigative Service Unit at USP Hazelton investigated the case

Assistant U.S. Attorney Shawn Morgan prosecuted the case on behalf of the government and U.S. District Judge Irene M. Keeley presided.
