BECKLEY, W.Va. — A Florida man charged with second degree murder following a wrong way deadly accident on the West Virginia Turnpike last month will undergo a psychological evaluation before his preliminary hearing in Raleigh County Magistrate Court.
Rafael Herrera, 43, of Miami, Fla., appeared in court Friday. He waived the 10-day requirement to have a preliminary hearing following an agreement on the evaluation.
Herrera was driving the wrong way on the Turnpike March 22 and struck an approaching vehicle head-on being driven by Lisa McCormick, 43, of Knoxville, Tenn. McCormick, a Kanawha County native, was killed, her two daughters and a family friend were critically injured. They remain hospitalized in Charleston.
State troopers said Herrera turned around near the Ghent toll plaza and started driving north in the southbound lanes.
Herrera is being held without bail in the Southern Regional Jail.
