Suspects in Elkins drive-by shooting indicted by grand jury

ELKINS, W.Va. — The case of three of the four men accused of shooting at a woman driving with her 2-year-old child will head to Randolph County Circuit Court.

Juan Sanchez Garcia, 28, Franciso Xavier Nunez, 26, and Richard James Sanchez, 28, all of Elkins, were named among the 26 indictments returned by a grand jury Monday.

Back in February, Emanuel N. Martinez, 24, attempted to fire upon the vehicle from a vehicle allegedly driven by Garcia near the intersection of 11th Street and South Henry. Nunuez and Sanchez were alleged to be passengers in the vehicle.

After viewing surveillance video taken from around the area, authorities were able to locate the suspects at a mobile home along Leading Creek Road in Montrose.

At the residence, pills, drug paraphernalia, cash and stolen firearms were seized, according to Elkins Police.

Martinez entered into a plea deal earlier in June, which convicted him on one felony count of attempted first-degree murder.

Garcia was indicted on eight felony counts of wanton endangerment involving a firearm, two felony counts of possession with intent to deliver a controlled substance, two felony counts of conspiracy and one felony count of attempted first-degree murder.

Nunez and Sanchez were both indicted on one felony count of attempted first-degree murder and one felony count of conspiracy.

Plea deals offered to the defendants earlier in June were rejected.

The three remain in custody at Tygart Valley Regional Jail.
