WAYNE, W.Va. — A lawsuit filed Tuesday against CSX alleges that about 300 Fayette County residents were exposed to chemicals in a February train derailment.
According to the lawsuit, the train, carrying Bakken crude oil, spilled thousands of gallons of oil into the ground and into the Kanawha River. Hundreds of residents had to be evacuated.
A cause of the 14 to 17 car derailment has not been determined. The lawsuit claims that CSX did not take the proper measures to prevent the accident.
The complaint was filed in Wayne County Circuit Court.
The railroad agreed in March to a plan with the EPA for cleaning up and restoring the land damaged around the site of the derailment.
