$3.5 million settlement reached between state departments, drug wholesaler

CHARLESTON, W.Va. — A $3.5 million settlement has been reached between the state Attorney General’s Office, the state’s Departments of Health and Human Resources and Military Affairs and Public Safety and H.D. Smith Wholesale Drug Co.

The agreement resolves allegations that H.D. Smith failed to detect, report and stop the flood of suspicious drug orders into West Virginia. H.D. Smith denied the allegations.

The drug wholesaler will now have to comply with state law to report any suspicious orders.

The plaintiffs want to use their settlement funds to fight the drug epidemic in West Virginia.

H.D. Smith is required to pay the full, agreed upon amount within the next 45 days.
