Nitro police officer faces brandishing charges after off-duty argument

NITRO, W.Va. — A Nitro police officer faces charges following an incident Thursday in which he was seen in a video holding a gun.

Cpt. Richard Foster was not on duty when he was allegedly arguing with three men while holding a handgun. The incident began after the people were trying to move a trailer onto a property next to Foster’s family.

According to witnesses, Foster’s mother was allegedly blocking the way and asked to see the permits for the move. Someone told her to move out of the way, which led to her getting her son involved.

Part of the argument was captured on video and posted on Facebook.

Nitro Police Chief Bobby Eggleton said Foster has been placed on administrative leave. He has also been relieved of his police weapons, vehicle and police identification.

The Kanawha County Sheriff’s Office issued a brandishing warrant for Foster, in which he turned himself in to authorities.
