Nicholas County man to spend 10 years behind bars after attempting to entice minor

CHARLESTON, W.Va. — A Nicholas County man will spend 10 years in prison after previously pleading guilty to attempting to entice a minor to engage in sexual activity.

John Marshall Underwood, Jr., 44, of Gilboa, admitted that from December 2016 to February 2017, he communicated with a woman he believed to be a prostitute who had custody of two minor nieces. That woman was actually an undercover law enforcement officer.

Underwood at least twice also talked to an individual believed to be a niece and attempt to engage in sexual activity. That niece was also an undercover law enforcement officer.

Underwood had arranged a meeting with the individuals and was arrested after arriving at the location.

As part of the sentencing, Underwood will be on federal supervised release for 15 years after his prison sentence.
