Age discrimination lawsuit against Department of Agriculture settled

CHARLESTON, W.Va. — The state Department of Agriculture agreed to a settlement recently with a former employee in an age discrimination case.

The department agreed to pay Marvin Warner, of Beverly, $330,000. Warner agreed to drop the case in exchange for the settlement amount. The department admitted no fault or liability.

Warner was 58-years-old when he was fired by the Department of Agriculture in June 2015 when Walt Helmick was state agriculture commissioner. He was replaced by an employee who was 27. Warner was the farm manager at Huttonsville. He had worked for the department for 35 years.

The lawsuit was filed in Kanawha County Circuit Court. Warner was represented by Charleston attorneys Mark Atkinson and John-Mark Atkinson.
