Jury convicts Hedgesville man on lesser charge in scalding death trial

MARTINSBURG, W.Va. — The jury was out about two hours Friday before rendering a verdict in the trial of a Berkeley County man in the scalding death of a toddler.

Michael McKinley, 31, of Hedgesville, was found guilty of the lesser charge, Child Neglect Causing Death. He had faced a charge of Child Abuse Causing Death, which carried a stiffer penalty.

The charges stemmed from the May 2016 death of Wesley Todd Mowery III of Hedgesville. The 14-month-old reportedly suffered 2nd and 3rd degree burns over 90 percent of his body after being exposed to scalding bath water.

Prosecutors had hoped to convince the jury that the scalding had been intentional and brought in experts who testified the baby’s injuries were consistent with a forced immersion into scalding liquid.

The defense brought up the possibility that the injuries could have occurred when McKinley left the toddler in the bathtub alone. McKinley had reportedly been drinking that day.

Defense Attorney Mark Sutton told WEPM News he believes the evidence supported a verdict of not guilty on the ‘abuse’ charge.

The neglect verdict carries a sentence of three to 15 years in prison. McKinley is set to be sentenced May 21.
