Settlement reached in part of lawsuits connected to stress tests

BECKLEY, W.Va. — Dozens of patients who took stress tests at the Raleigh Heart Clinic in Beckley and contracted hepatitis have agreed to a settlement.

It was okayed Friday by a Mass Litigation Panel in Charleston. The amount of money agreed to will remain confidential.

Nearly 100 former patients at the clinic sued the clinic, Dr. Thair Barghouthi, Cardinal Health and the state Department of Health and Human Resources.

“It’s technically a confidential settlement,” Beckley attorney Stephen New told the Register-Herald. “All claims against Dr. Barghouthi are resolved in full and he is released from liability.”

The case against Cardinal Health, which supplied the products for the stress tests, continues. It’s scheduled for trial next summer.
