United Mine Workers President Cecil Roberts loves college football.  He’s a long-time WVU season ticket holder and rarely misses a home game.  So it’s only natural that when talking about the EPA’s decision to delay 79 Appalachian surface coal mine permits, Roberts uses a sports analogy. 

Roberts says the EPA’s recent announcement that it is withholding the permits—at least for now—is like a college football referee throwing a flag on the first play of a Mountaineer game.  When Coach Bill Stewart asks what the flag is for, the ref says, “I’m not going to tell you.”

Roberts says, “Now, no one would find that to be fair, and it’s not.”

Roberts is among those trying to figure out why President Obama’s EPA has decided to further review the surface mine permits even though they have already been cleared by the U.S. Army Corps of Engineers.  The EPA has said it wants to make sure the permits comply with the Clean Water Act, but Roberts says the EPA’s actions leave the coal industry in a state of flux.

“The EPA isn’t certain what should be done right now about mountaintop mining,” Roberts told me, “but as time goes by there are people that may very well be laid off because of that.”

What is needed from the EPA are definitive guidelines that coal operators can follow when making their permit applications.  But instead, what the industry has now is uncertainty.

“We need rules that we can look at and if we disagree with them, we’ll fight over them in court or wherever,” Roberts said.  “If we agree with them, we’ll try to comply with them.  But right now, we have no rules.”

I reminded Roberts that this is his administration.  He worked hard for candidate Barack Obama with the belief that he would be good for the United Mine Workers and working people in general.  Is he disappointed?

 Not yet.  Roberts says there are other issues important to the union where Obama has delivered.  For example, Mr. Obama chose long-time UMWA leader Joe Main to head the federal Mine Safety and Health Administration.

Roberts again falls back to the football analogy.  “We’re halfway through the first quarter,” Roberts said.  “I think we should wait until the end of the four-year term which will be halftime and the end of the eight-year term which will be the full game and then evaluate what labor and working class people receive from this Presidency.”

True, safety is a key issue for the UMWA, and understandably so.  But first workers have to actually have jobs at coal mines before safety is relevant. 

Roberts and others with a direct interest in the economy of West Virginia and the Appalachian coal fields have put a lot of stock in the Obama Administration.  The outcome of the EPA permitting controversy will go a long way in determining whether they are in the huddle or just riding the bench.

Stopping the permits for surface mining is only the first step. Wait until Cap and Tax is passed. The White house admits it will cost the average family around $1700 more on the year in taxes and utilities. Most people have no idea about the home improvements part of the bill that will cost much more. Such as having to buy the most effecient of everything. Everything they are proposing in Washington will cost everybody money. Healthcare, cap and tax, Letting the tax cuts expire, etc. People had better wake up or it is going to be bad.
Just for the record, non-union "miners" who believe in right-to-work laws don't join the UMW.
Well, I reckon that Beany and Cecil both believed they had a seat at the Obama table.........naw, they knew they didn't. They aren't that stupid. They are that smart though...smart enough to keep the butter side of the bread up for them as it heads South when thrown to the floor by the anti-coal Obamaites.

Football analogies are for kids and voters...how could you keep a straight face, Hop?
Well, let me think about this for a minute.

Cecil Roberts, Robert C Byrd, Jay Rockefeller, Joe Manchin and Nick Rahall all came out and supported a man by the name of Barack Obama for President. He's for coal they all said... yeah...right! During the campaign, Obama and Biden both vowed to end coal fired power plants or make coal fired power so expensive you could not afford to build one. Now, I don't have a PHD or anything...but, if, I was a UMWA member... I don't think I would have voted to re-elect Cecil Roberts again. I'll also bet you'll see the leadership of the UMWA endorse all of the above "characters" in the next election. It appears that Barack Obama ...Mmm...Mmm...Mmm... meant what he said. The option of McCain was no alternative either. He was just as bad as the one we ended up with.

People, the 2010 and 2012 election will determine whether we survive as a Country. You'd better put aside political parties and do what is right for the Country...or it's over.

After a 14-day initial review period, the Environmental Protection Agency’s regional offices followed the lead of EPA headquarters, recommending that all 79 pending mountaintop removal mining valley fill permits be remanded into a full 60-day extended review process. [This is where the Ref throws the flag ??] The extended review will closely examine potential environmental and health impacts of the valley fills on headwater streams and watersheds, and is part of the EPA’s promise of a more stringent review process for overseeing mountaintop removal coal mining. [ Ah-ha ... this is where the Ref explains why the flag was thrown]

During the previous presidential administration, a change to the “fill rule” in the Clean Water Act allowed permits for mountaintop removal valley fills to be rubberstamped without conducting any environmental or health impact assessments.

So now, we have a slight pause in the process and the reason for the pause given. As for the Rules, Mr. Roberts you can get a copy where I got mine. What is not fair here ??

The Ref has thrown a flag, and it's being reviewed. No final decision yet. The game isn't over. You have 60 more days as of October 14.
Mr. Roberts seems to have received what he supported ("Electricity rates wil necessarily rise under my plan" and yes you can find it on the web). Perhaps he misread the Candidate who supported SEIU and the President who supports the UAW; the UMW seems to be left out in the cold (soon to be literal). And while we're talking about politicians, don't forget the good WV junior Senator's stance on the industry. I agree with Captain Q. I laughed at this column when it ended with, (and I'm paraphrasing a bit here), "He's screwing us, but we're gonna bend over and keep on taking it indefinitely because he has a 'D' after his name!"

What an out-and-out fool! But then, so are the people of WV for continually sending Jay Rockefeller back to the Senate when his ambitions to put the coal business out of business are the same as O's.
Stinkbomb makes a great point and I'm wondering if you can provide us with the facts, given your company's close relationship with the coal operators you may not be able to but the questions that need answered are these. Can we go into the mountain and bring the coal out without destroying the mountain? Maybe the coal is so close to the surface it can't be done or is it that the cost per ton to surface mine is a few dollars less? I would like an honest answer to that question. The coal will be mined either way, I would think if you can go into the mountain and mine there would be a lot more miners employed. May not be as good for the operators but for miners and West Virginia overall wouldn't that be better? Once we have an honest answer to that question then we can judge the Obama administrations actions accordingly.
Hops, is it true that coal can be mined underground and that surface mining isn't the only way to extract coal? What, you say, there is underground mining? Well, I'll be switched. And, what you say, Obama thinks underground mining is okay? Well, I'll be switched again. What will they think of next? Underground mining. Incredible.

What did Cecil Roberts expect when he supported the Obama-Biden ticket? Did he not hear their comments on coal? Did he not hear Steven Chu, Obama's Secretary of Energy shortly after he was sworn in? Obama promised change, and unfortunately for West Virginia, its workers and tax base, this is one area where he is delivering change.
Hoppy, it is so laughable that Cecil Roberts, the UMW chief who literally FORCED his union to endorse Barrack Obama is now discovering what the rest of us in WV knew already: Obama HATES coal! Cap & Tax was aimed mostly at making coal powered energy more expensive and thus, coal less desirable. It's no surprise that the Obama controled EPA has revoked all those permits, OBAMA HATES COAL! Cecil Roberts, while he was cheering for Obama in the election, apparently wasn't listening to Joe Biden on the campaign trail when he called coal "evil" during a campaign swing in Ohio. If anyone looks bad in all this (besides Obama) it's Cecil Roberts for 'selling out' to a candidate and political party bent on destroying the very industry's workers he CLAIMED to REPRESENT!

What more can be said here? Cecil Roberts' plight is a great example of what happens when you BLINDLY follow ANY political party, PERIOD!
