Pocahontas Coal Company, MSHA reach agreement on Affinity Mine

BECKLEY, W.Va. — Pocahontas Coal Company announced Friday it has entered into an agreement with the U.S. Mine Safety and Health Administration to terminate a 2013 notice about a pattern of violations at its Affinity Mine.

According to the company, an agreement was reached Aug. 28

The notice was issued on Oct. 24, 2013. The company’s Affinity Mine has since improved its safety and regulatory compliance history, and 10 percent of the total number of enforcement actions have been marked as significant and substantial violations.

The company also entered litigation against MSHA regarding the Raleigh County mine. After two years of related efforts, the case was in appeal for almost an additional two years. This week’s settlement removes the case from consideration.
