CHARLESTON, W.Va. — A Hardy County man has been indicted by a grand jury on charges stemming from the death of a child last September.
Carlos Alberto Ortiz Jr. was indicted on Feb. 4. Ortiz, 28, faces charges of murder and child abuse resulting in injury for the death of Danzil William Westfall.
First responders and police responded to a home on Second Street in Moorefield regarding a report of a child injured after falling from a porch. Ortiz lived at the residence with the child’s mother, 27-year-old Allison Westfall.
Authorities reported Danzil had a fractured skull and brain injuries. Neighbors told investigators they did not see Ortiz and the child on the porch.
Medical personnel later ruled Danzil’s several skull fractures happened more than two weeks before the call.
Susan Lewis, Danzil’s grandmother, alleged the child had been abused in June, and she contacted police and Child Protective Services about the matter.
