Names submitted to Justice to make up first state Intermediate Court

CHARLESTON, W.Va. — Gov. Jim Justice’s Judicial Vacancy Advisory Commission has forwarded the names of 8 candidates to Justice for possible appointment to the state’s new Intermediate Court of Appeals.

Monday’s letter from the commission to Justice makes three recommendations for each seat available on the new court.

The list also includes former Greenbrier County circuit judge and state lawmaker Jim Rowe, former Monongalia County Circuit Judge Debra Scudiere and current Putnam County Prosecutor Mark Sorsaia.

Former Kanawha County Circuit Judge and current House of Delegates Chief Counsel Dan Greear has been submitted as one of the three names for both the two and a half year term and the four and a half year term.

The commission interviewed 23 candidates on Dec. 9-10.

Gov. Justice will make one selection for each seat. Elections will be held on a staggered basis when the initial terms are completed.

The ICA will begin its work July 1.

The commission submitted the following names:

2.5-year term: July 1, 2022-Dec. 31 2024

Dan Greear, South Charleston
Jim Rowe, Lewisburg
Thomas Scarr, Barboursville

4.5-year term: July 2, 2022-Dec. 31, 2026

Robert Frank, Lewisburg
Dan Greear, South Charleston
Deanna Ray Rock, Keyser

6.5-year term: July 1, 2022-Dec. 31, 2028

Debra Scudiere, Morgantown
Mark Sorsaia, Hurricane

State Supreme Court Chief Justice Evan Jenkins released the following statement about the names submitted:

“While the Justices and Court Administrative Staff continues to work on the logistics of the Intermediate Court of Appeals, the Judicial Vacancy Advisory Commission also had the important task of interviewing more than twenty attorneys interested in being judges for the new court,” Jenkins said. “They have done their due diligence and given their recommendations to Governor Justice. The Governor now has the important task of selecting from this list of candidates to serve on the new court. We look forward to working with whomever he appoints.”
