GLENVILLE, W. Va. – The West Virginia State Police arrested and charged Gilmer County Commissioner Brian Kennedy with a DUI over the weekend.

Senior Trooper K. J. Varner II pulled Kennedy over at 8:00 p.m. on Saturday after he was seen driving erratically on U.S. 33 in Gilmer County.

Once pulled over, Varner said he detected alcohol on Kennedy’s breath and initiated the proper procedures.

A secondary chemical test revealed Kennedy’s BAC was at 0.089, which is over the 0.08 limit.

Varner said Kennedy was cooperative while detained until around 10:30 p.m., when Magistrate Judge Carol L. Wolfe arraigned and released him on a personal recognizance bond.

According to Judge Wolfe’s office, as of Monday, no dates have been set in regard to the case.

A representative from the Gilmer County Commission has not yet been available for comment on the matter at this time.

    I always assume it is a Democrat when something bad is reported about an elected official and no party is mentioned. Otherwise, the headline would be REPUBLICAN County Commissioner, John Doe a REPUBLICAN.....

    Here's a surprise! Gilmer County Commissioner Brian Kennedy is a democrat, (d), liberal, and socialist. (Interesting how they always forget to put that (d) after those dumb liberal's names when they post news stories about them.) He and State Delegate Clifton "Clif" Moore, also a democrat (d - McDowell), liberal, socialist, and all around drunk now have something in common to chat about when attending the liberal conventions and chugging drinks at the bar.

    Hey Larry! What if he hit one of your family members and he blew a .089 BAC? Guess it all looks differently depending on which side of the dead body you are standing on. A drunk is a drunk.

      DL, you are correct! I have been a wittness to two seperate DWI incidents resulting in 5 fatalities. Impaired driving is impaired driving. Until you have to testify in court and see the lives changed for ever you don't realize that .089 BAC is still impaired driving!

        WV77Steve, unfortunately, been there, done that, and don't want a t-shirt. I lost count after about the 100th DUI arrest and Lord knows how many fatalities. A drunk just doesn't care. Fining them doesn't matter. The legal bill doesn't matter to them. Nor does jail. But tell them they will lose their driver's license and they will fight you tooth and nail. I'm all in favor of requiring a convicted DUI driver to have to display a special issued license plate on any vehicle to which they operate that indicates they are a convicted inebriated driver. This would tip off LE to watch them closer and second, publicly stigmatize them. Should they be caught driving a vehicle without the special plate, they will no longer be permitted to drive and you make that offense a felony - PERIOD!
