CHARLESTON, W.Va. — After a lawsuit was filed against the state over it’s abortion law, Attorney General Patrick Morrisey has in response filed a motion to intervene.
The lawsuit was filed by the Women’s Health Center of West Virginia against the West Virginia Board of Medicine and their president and secretary. The health center claims the law violates the 14th amendment of the U.S. Constitution.
Morrisey in a statement released Friday said, “We have a strong case and we are ready to defend West Virginia’s abortion law to the fullest.”
The Attorney General added on to that, stating he’s proud of his stance on the issue. “As your first pro-life state Attorney General, I will stand strong for the life of the unborn and will not relent in our defense of this clearly constitutional law,” he said.
The Women’s Health Center, which had been the state’s last abortion clinic, filed the federal lawsuit last fall. They have said the state’s law is “irrational and unconstitutional.”
The bill was passed by lawmakers in September of 2022. It doesn’t allow for an abortion at any time during a pregnancy.
“I will always stand for the most vulnerable of our society and the sanctity of life,” Morrisey said.
