BECKLEY, W.Va. — Authorities are investigating an allegation against a Raleigh County Planet Fitness employee, after a member of the health club told police she had been spied on, while using the gym’s tanning facilities. According to Beckley Police, a male employee, whose identity was not disclosed, confessed to observing a woman in a voyeuristic manner, while the woman was using a tanning bed in a private room at the location. The employee reportedly was in possession of a video recording device at the time the alleged incident occurred, though it was not clear whether the device was used to record the accuser or anyone else using the tanning rooms.

A statement released Monday by Planet Fitness corporate offices in New Hampshire said, in part, “The safety and privacy of our members is our top priority at Planet Fitness, and we can confirm that the franchise owner is currently working closely with the local authorities to assist in their investigation.”

Police Detective David Allard said no arrests have been made, nor have any charges been filed in connection with the incident, which remains under investigation.

It is illegal in West Virginia to record private images of another person in a setting where privacy is a reasonable expectation, and it is illegal in the state to share or transmit sexually explicit or intimate images of someone without that person’s consent. Penalties can include a fine of up to $5,000 and one year in jail.

The Planet Fitness location in Beckley opened in December 2018.
