Harrison County Magistrate arrested on sexual abuse charges

CLARKSBURG, W. Va. — A Harrison County Magistrate has been arrested on charges of sexual abuse involving a minor.

Magistrate Mark Alan Gorby, 60, of Bridgeport is alleged to have forced sexual intercourse on a female from when she was the age of 8 in 2005 until she was 12 in 2009.

According to the complaint filed by West Virginia State Police Cpl. K.G. Murray, the victim was living with the Gorby as his step daughter at the time of the alleged assaults.

The first incident occurred in the victim’s bedroom with Gorby allegedly telling the victim “her mother wasn’t doing her job and she needed to step up and be a big girl” before forcing himself on her.

Allegedly, he forced sexual intercourse on the victim in her bedroom one other time, two times when he forced her to sleep in his bed while the victim’s mother was out of town for business and the final time, he forced himself on the victim in the family living area while she was sleeping on the couch.

Gorby is charged with five counts of sexual abuse by a parent, guardian, custodian or person in a position of trust to a child. If convicted, he faces 10 to 20 years in prison per count.

He appeared before Special Magistrate Kim Blair Thursday afternoon and was released after posting $100,000 bond. A hearing in the case is scheduled for October 22 before Blair.
