WILLIAMSON, W.Va. — A man shot by accused murderer Timothy Kennedy was on the witness stand in day two of Kennedy’s trial in Mingo County Circuit Court.

Kennedy, 32, is charged with the June 2023 shooting death of State Police Sgt. Cory Maynard.
Maynard was responding to the Beech Creek area after Benjamin Baldwin had been shot. Kennedy is charged with attempted murder in the Baldwin shooting.
Baldwin told jury he’s had to learn to walk again.
“So up to date you’ve had seven surgeries?” The prosecutor asked.
“Yes,” Baldwin said.
The prosecutor continued, “It’s almost three years later and you say you have three surgeries remaining?”
“Yes,” Baldwin said.
He added he lost part of his liver, colon and small intestine.
Kennedy allegedly shot Baldwin and then ambushed Maynard when he arrived. Prosecutors said he shot Maynard and them used a gun to beat him.
The defense said in its opening statement that Kennedy was defending himself in the dispute with Baldwin and that he was hallucinating, high on meth, when Maynard arrived.
An investigating state trooper also testified Tuesday about locating the murder weapon.
Testimony is scheduled to continue Wednesday in Williamson.
