WILLIAMSON, W.Va. — A Mingo County circuit judge says prosecutors will be able to show body cam video in connection with an upcoming trial for the man charged with killing a state police trooper.

Timothy Kennedy, 31, is charged in the June 2023 shooting death of Sgt. Cory Maynard.
Judge Joshua Butcher heard testimony in a pretrial hearing Friday and ruled, as reported by WCHS-TV, the jury can view the video that came from the body camera Maynard was wearing.
Maynard and other law enforcement went to the Beech Creek area of Mingo County to investigate a shooting. As they approached the house, Maynard was fatally shot in an ambush, prosecutors said.
Kennedy was arrested after an intense manhunt and charged with Maynard’s murder and the wounding of another person which prompted the original call.
Kennedy’s attorney urged Judge Butcher Friday to not allow the video in as evidence. His said Kennedy would stipulate to several things in exchange for leaving it out including that he shot Maynard and took his service weapon after he did it.
The defense has indicated it will present a self-defense case claiming Kennedy was under the influence of drugs which impacted his judgement.
Kennedy’s trial is scheduled to begin Dec. 8. A change of venue hearing is set for Nov. 25.
