MINGO COUNTY, W.Va. –Day three of the trial for the man accused of killing a West Virginia State Trooper focused on his mental state the day of the shooting.
Timothy Kennedy, 32, is charged with the June 2023 shooting death of State Police Sgt. Cory Maynard. Kennedy allegedly ambushed Maynard and other officers while they were responding to another shooting involving Kennedy.
WCHS’s Bob Aaron reported that both a trooper, who transported Kennedy to jail, and the nurse who evaluated his said he acted normally.
Kennedy’s defense attorney used the cross examination of both the trooper and nurse to bring up the drug test that was performed, which showed he had multiple drugs in his system.
Monday, during their opening statements, Kennedy’s attorneys told the jurors that he was stoned on meth, experiencing hallucinations and likely lacked the intent for first-degree murder.
The attorneys were able to get both to say they were not mental health experts despite their prior interactions with drug users. They also said they plan on calling an expert witness.
Tuesday during the trial, the man from the first shooting, Ben Baldwin, testified saying since the incident he has had seven surgeries, with three surgeries remaining.
A state trooper also testified about locating the murder weapon inside the car Kennedy was in when he was captured.
