CHARLESTON, W.Va. — The state Public Service Commission has ordered the Gauley River Public Service District to implement an agreement to allow West Virginia Water Company to begin operating its system that provides water to the Mount Olive State Prison in Fayette County.
It’s been more than two years since the PSC ordered the operation and management (O&M) agreement but Gauley River PSD appealed to the state Supreme Court.
The appeal was unsuccessful.
The PSC order issued Tuesday said it’s time to the put the deal in place.
“The parties have failed to execute and implement the O&M agreement ordered by the Commission despite numerous Commission directives,” the new order said.
The PSC wants a status report from Gauley River PSD and West Virginia American Water in 10 days detailing an action plan.
