Jefferson County Sheriff Robert “Bobby” Shirley has resigned as sheriff according to Jefferson County Commissioner Patsy Noland.
Shirley’s resignation comes on the heels of his scheduled court appearance in the case involving the alleged beating of convicted bank robber Mark Daniel Haines, of Harpers Ferry.
Back in June, Shirley was indicted by a federal grand jury
on one count of deprivation of rights under the color of law and falsifying a document with the intent to obstruct a federal investigation in connection with the December 27, 2010 incident.
Shirley is accused of kicking and stomping Haines after a police pursuit following a failed bank robbery. He is also accused of falsifying records during a subsequent investigation.
He had been scheduled to go to trial on January 22 in Martinsburg’s U.S. District Court on the charges, but his attorney filed a motion last week to continue the trial.
Shirley is scheduled to appear in court Monday for a hearing in the case.
