MINGO COUNTY, W.Va. –Jury selection got underway Tuesday in Mingo County for the second trial for a man accused of killing a West Virginia state trooper in June 2023.

Timothy Kennedy Jr., 32, of Matewan appeared in court where they began the process ahead of a new trial scheduled to begin May 4.
Kennedy faces charges of first-degree murder, first-degree robbery, disarming a law enforcement officer, and two counts of attempted first-degree murder.
He was indicted on the charges in January 2024 following an incident in the Beech Creek area that left West Virginia Police Sgt. Cory Maynard dead.
Investigators stated that Maynard and other officers were responding to an earlier shooting when Kennedy ambushed the officers, fatally shooting Maynard before fleeing the scene.

Benjamin Baldwin, the victim from the first shooting, was critically injured after investigators said that Kennedy shot him multiple times.
The case has faced multiple delays, including a recent mistrial in December during the fourth day of attempting to seat a jury.
The goal is to have about 20 people selected for the jury.
