CHARLESTON, W.Va. — A class action lawsuit connected to unnecessary surgeries at Charleston Area Medical Center has settled out of court for $40 million.
The settlement was announced Friday in a news release from CAMC.
The lawsuit was filed in April 2025 against CAMC and doctors Robert Shin and Samuel Rossi alleging unnecessary hernia repair procedures were taking place during bariatric surgeries. The doctors are no longer with the hospital.
The lawsuit was filed after CAMC began contacting patients about the procedures. There could be more than 4,000 people in the class.
CAMC issued a statement Friday:

Plaintiffs’ co-counsel Ben Salango said he was pleased to be able to settle the complex case.
“CAMC, counsel and the class representatives participated in early good faith negotiations over the last year to bring about a good faith and fair resolution and to work on the details of that resolution,” Salango said in Friday’s news release.
Plaintiffs’ attorney Dante diTrapano said, “This settlement represents a significant and positive outcome for our clients and the entire class.”
Once the settlement is approved by the court, the members of the class will receive a monetary payment.
